Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the RecruitVerse platform, website, and related services ("Service") provided by Gayatri Infotech ("RecruitVerse", "Company", "we", "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By registering an account, using the platform, or clicking "I Agree", you confirm that you are at least 18 years old, have the legal authority to bind your organisation (if using the Service on behalf of a company), and agree to these Terms and our Privacy Policy.

2. Description of Service

RecruitVerse is a cloud-based enterprise recruitment automation platform that enables organisations to manage job requisitions, applicant tracking, campus recruitment, interview scheduling, offer management, and workforce analytics. The Service is provided on a subscription basis with plans as described on our pricing page.

3. Account Registration & Security

• You must provide accurate and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must immediately notify us of any unauthorised use of your account
• One account per organisation; sharing credentials across organisations is prohibited
• RecruitVerse is not liable for losses arising from unauthorised account access due to your failure to safeguard credentials

4. Subscription & Payment

4.1 Plans: The Service is offered under Starter, Growth, Professional, and Enterprise plans. Features vary by plan as detailed on the pricing page.

4.2 Free Trial: A free trial period may be offered on eligible plans. Trial access is subject to fair use and does not include all enterprise features.

4.3 Payment: Subscription fees are payable in advance, annually unless otherwise agreed in writing. Payment via NEFT, RTGS, cheque, or UPI as per invoice.

4.4 Late Payment: Accounts with overdue invoices (30+ days) may be suspended. We reserve the right to charge interest at 1.5% per month on overdue amounts.

4.5 Refunds: Subscription fees are non-refundable except where required by applicable law or where we fail to provide the Service as described.

5. Acceptable Use Policy

You agree not to use the Service to:

• Post fraudulent, discriminatory, or unlawful job listings
• Upload malware, viruses, or malicious code
• Scrape, harvest, or extract data from the platform via automated means
• Impersonate another person or entity
• Violate any applicable Indian or international laws, including employment laws and data protection regulations
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Use the Service to spam, phish, or conduct deceptive practices against candidates

Violation of this policy may result in immediate account suspension without refund.

6. Data Ownership & Candidate Data

6.1 Your Data: You retain ownership of all data you upload to the Service, including job descriptions, candidate profiles, and company information ("Client Data"). We process Client Data as a data processor on your behalf.

6.2 Candidate Consent: You are responsible for obtaining valid consent from candidates before collecting and processing their personal data through the platform, as required by the DPDP Act 2023.

6.3 Our Rights: We may use aggregated, anonymised, non-identifiable data derived from platform usage for product improvement and analytics purposes.

7. Intellectual Property

The Service, including its software, design, trademarks, and content ("RecruitVerse IP"), is and remains the exclusive property of Gayatri Infotech You are granted a limited, non-exclusive, non-transferable licence to use the Service solely for your internal business purposes during the subscription period.

You may not copy, modify, reverse-engineer, disassemble, or create derivative works of the Service or RecruitVerse IP without our prior written consent.

8. Service Availability & SLA

We target 99.5% uptime for the platform, excluding scheduled maintenance (with advance notice) and events beyond our reasonable control. Planned maintenance will be communicated at least 48 hours in advance. We do not guarantee uninterrupted or error-free access to the Service.

9. Limitation of Liability

To the maximum extent permitted by law, RecruitVerse's total liability for any claim arising out of or related to these Terms or the Service shall not exceed the fees paid by you in the 12 months preceding the claim.

We are not liable for: (a) indirect, incidental, consequential, special, or punitive damages; (b) loss of profits, data, business, or goodwill; (c) hiring decisions made using the platform; (d) third-party integrations or external services; or (e) circumstances beyond our reasonable control.

10. Indemnification

You agree to indemnify and hold harmless RecruitVerse and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law; (c) your failure to obtain required candidate consents; or (d) any dispute between you and a candidate or third party.

11. Termination

11.1 By You: You may cancel your subscription at any time with 30 days' written notice. No refund will be issued for the remaining subscription period.

11.2 By Us: We may suspend or terminate your access immediately for material breach of these Terms, non-payment, or conduct that harms the Service or other users. We will provide 14 days' notice for termination for convenience.

11.3 Effect of Termination: Upon termination, your access will cease. We will provide a data export in standard format within 14 days of your request. After 60 days post-termination, your data may be permanently deleted.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India. We encourage amicable resolution and will attempt to resolve disputes informally within 30 days before resorting to litigation.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-platform notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
